INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in July 2018. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in July 2018. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of July 2018 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Section 2.A Canada Acts

Canadian Environmental Protection Act, 1999 : SOR/2018-129 and SOR/2018-130 amend Schedule 1 (List of Toxic Substances) with items 141 (Acetamide, N-[4-[(2-hydroxy-5-methylphenyl) azo]phenyl]-) and 140 (Phenol, 5-chloro-2-(2,4-dichlorophenoxy)-).

Loi canadienne sur la protection de l’environnement (1999)

Food and Drugs Act : S.C. 2018, c. 9, s. 72 amends the Act to not apply to a tobacco or vaping product as defined in section 2 of the Tobacco and Vaping Products Act.

Loi sur les aliments et drogues

Hazardous Products Act : S.C. 2018, c. 9 s. 77 is in force amending paragraph 12(h) to reference the Tobacco and Vaping Products Act.

Loi sur les produits dangereux

Non-Smokers' Health Act : S.C. 2018. c. 9 amends subsections 2 (1) and 7 (1) related to the definition of "smoke" and "vaping product".

Section 2.B Canada Regulations

Aviation Occupational Health and Safety Regulations (Canada Labour Code): S.C. 2018, c. 9 amends paragraph 5.23(1)(a) to reference the Tobacco and Vaping Products Act.

Règlement sur la santé et la sécurité au travail (aéronefs)

Canada Occupational Health and Safety Regulations (Canada Labour Code): SOR/2018-137 amends Section 10.19 (1) (a) -(c) regarding occupational exposure limits (OELs) for hazardous substances, including grain and flour dust. S.C. 2018, c. 9 amends paragraph 10.30(1)(a) to reference the Tobacco and Vaping Products Act.

Domestic Substances List (Canadian Environmental Protection Act, 1999) (SOR/94-311): SOR/2018-123 adds 9 substances to Part 1 and add 12 substances to Part 3. SOR/2018-124 adds 6 substances to Part 1 and addes 17 substances to Part 3.

Maritime Occupational Health and Safety Regulations (Canada Labour Code): SOR/2018-137 amends Sections 255 (1) (a) and (b), and 255 (2) regarding occupational exposure limits (OELs) for hazardous substances, including grain and flour dust. Division 2 ONTARIO AMENDMENTS

Section 2.A Ontario Acts

Highway Traffic Act : Three amendments have been applied. S.O. 2015, c. 14 repeals Sections 41.1, 41.2, and 41.3 of the Act and amends Sections 203 and 204 regarding Medical Reports. S.O. 2017, c. 2 (Sch. 17) adds Section 110.5 (Over-dimensional vehicle escorts) and amends subsection 146.1 (5). S.O. 2017, c. 26 (Sch. 4) makes amendments related to prohibition of drugs (Section 44.2), licence suspension (Ss 48.0.2, 48.0.3, 48.0.4), and breath testing (S. 48.2.2) for novice drivers.

Mining Act : S.O. 2017, c. 24, s. 78 repeals and replaces subsection 171 (1) (Application of Construction Act) and replaces "Construction Act" in subsections 171 (2) and (3).

Provincial Offences Act : S.O. 2017, c. 26, Sch. 3, s. 27 amends a reference in Section 12.

Section 2.B Ontario Regulations

Air Pollution - Local Air Quality (Environmental Protection Act): O. Reg. 109/18 amends Section 10 (Operating Conditions) by adding subsections 1.1-1.11, adds section 24.1 (Incident-specific ESDM report), and updates Schedules 2, 3, 6, 7, and 8.

Boilers and Pressure Vessels (Technical Standards and Safety Act): O. Reg. 420/17 repeals and replaces sections 10 and 11 adding sections 10.1, 10.2, 11.1, 12.1, 12.2 and 16 pertaining to inspections and applications.

Commercial Motor Vehicle Inspections (Highway Traffic Act): O. Reg. 208/18 amends subsection 11 (7) (UNDER-VEHICLE INSPECTIONS) by substituting "whichever occurs last".

Definitions of Commercial Motor Vehicle and Tow Truck (Highway Traffic Act): O. Reg. 336/18 adds section 4.1 which provides the definition for commercial motor vehicles.

Designations (Regulatory Modernization Act): O. Reg. 147/18 repeals and replaces regulations in the schedules, and strikes out "O. Reg. 428/15 (Public Spas)" wherever it is mentioned.

Display Screens and Hand-held Devices (Highway Traffic Act): O. Reg. 214/18 adds paragraph 6 to subsection 12 (2).

Drinking-Water Systems (Safe Drinking Water Act): O. Reg. 509/17 repeals and replaces the definitions of "children’s camp" and "food service establishment" in section 1.

Fire Code (Fire Protection and Prevention Act): O. Reg 108/18 amends Table 1.2.1.A of Division B, revokes and substitutes article 6.4.1.3 (Fire Department Connections), as well as subsection 6.4.3 "Checking, Inspection and Testing".

Firefighters (Workplace Safety and Insurance Act): O. Reg. 311/18 adds new paragraphs to Section 4 and adds more cancer definitions in Section 5.

General (Clean Water Act): O. Reg. 206/18 repeals and replaces subsection 51 (2) and adds to subsections 31, 40 (2), 48 and 51 (1).

General (Endangered Species Act, 2007): O. Reg. 176/13 is in force revokes s. 11 and adds s. 11.1 (R.H. Saunders Station - American eel).

Hours of Service (Highway Traffic Act): O. Reg. 213/18 repeals and replaces subsections 3.2 (2) and 3.2 (5), and also replaces "the exemption in paragraph 6" and substituting "the exemptions in paragraphs 6 and 7" wherever it appears.

Lamps - Use of Flashing Red or Green Lights (Highway Traffic Act): O. Reg. 339/18 adds section 1.1 pertaining to the use of flashing red and blue lights.

Safety Inspections (Highway Traffic Act): O. Reg. 163/17 subsection 1(2) is in force amending the wording in s. 4.0.1.

Loi sur les normes du travail

Act respecting occupational health and safety : S.Q. 2018, c. 12 is in force amending s. 144 to change the length of a term to three years for members of the board of directors and they can only be appointed three times. Section 153.1 is added which prohibits a person holding a management position in an employers’ association or a union association from being a member of both the board of directors of the Commission and that of the Commission de la construction du Quebec.
