INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in March 2018. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in March 2018. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of March 2018 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Canadian Environmental Protection Act : SOR/2018-20 is making an addition of "natural gas condensates" to Schedule 1 List of Toxic Substances.

Species at Risk Act: SOR/2018-10 is making various amendments to animal species names in parts 1-4 of Schedule 1.

Section 2.B Canada Regulations

Benzene in Gasoline Regulations (Canadian Environmental Protection Act): SOR/2018-11 is in force making various amendments by replacing sections and definitions. The French version is amended by replacing "tension" with "pression" in various sections.

Contaminated Fuel Regulations (Canadian Environmental Protection Act): SOR/2018-11 repeals section 1; adds subsection (3) to section 4 Exemptions; replaces subsections in section 5 Maintenance of Records; and, replaces "inspector" with "enforcement officer" is section 6 Production of Records and Documents.

Tetrachloroethylene (Use in Dry Cleaning and Reporting Requirements) Regulations (Canadian Environmental Protection Act): SOR/2018-11 replaces subsection 8(1) and 8(1)(a) referring to the transportation of waste water to a waste management facility by the owner or operator of a dry-cleaning machine.

Firefighters’ Primary Site Cancer Regulation (Workers’ Compensation Act): Alta. Reg. 2/2018 is in force making amendments to definitions in section 2 Designated cancers and periods of employment, and repealing section 3 Expiry.

Forest Resources Improvement Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 5/2018 updates the definition of Minister in Section 1 and revises the expiry date in Section 13.

Wildlife Regulation (Wildlife Act): Alta. Reg. 18/2018 adds a new section 104.1 Weapons for hunting big game.

Section 2.A Quebec Acts

Act respecting industrial accidents and occupational diseases : S.Q. 2016, c. 25 s. 23 is in force Apr. 1, 2018 amending s. 11 to remove reference to the Youth Alternative Program.

Building Act : O.C. 86-2018 proclaims Mar. 8, 2018 as the date of coming into force of s. 214 as regards the Act respecting pressure vessels.

Environment Quality Act : S.Q. 2017, c. 4, remaining sections (except s. 118.5 enacted by s. 188) are in force Mar. 23, 2018 making extensive amendments to the Act in order to modernize the environmental authorization schemes it prescribes to take climate change issues more fully into account. The changes clarify the elements to be considered when examining authorization applications and defines the scope of the Minister’s power to prescribe conditions in an authorization in order to protect the quality of the environment. The Minister may take into account the greenhouse gas emissions attributable to a project. The Act is reformatted into Title I (Chapters I to XIV) and Title II (Chapters I to V). S.Q. 2017, c. 14 is in force Mar. 23, 2018 adding ss. 46.02-46.11 and making further amendments to the provisions of 2017, c. 4.

Sections 37-39 are repealed.
